The Legal Framework for Florida Injury Claims
Florida injury law is built on the principle of negligence: a party who breaches a duty of care and causes harm can be held financially responsible. This framework governs car accidents, premises liability, medical malpractice, and most other injury claims in the state.
Pure Comparative Negligence
Florida is one of a minority of states that applies pure comparative negligence. Under this rule, a victim can recover damages even if they are 99 percent at fault, though the award is reduced by their percentage of fault. This is generous compared to states that bar recovery above 50 percent fault, and it means almost every victim has some path to recovery.
Florida's No-Fault Auto Insurance System
For auto accidents, Florida requires no-fault Personal Injury Protection. PIP pays medical expenses and lost wages regardless of fault, but it does not pay for pain and suffering. To step outside the no-fault system and sue the at-fault driver, the victim must meet the serious injury threshold defined by statute.
The Statute of Limitations
Florida law imposes strict deadlines. Personal injury claims generally must be filed within two years of the injury. Wrongful death claims must be filed within two years of death. Medical malpractice claims have a two-year deadline with a maximum four-year discovery rule, with special exceptions for minors. Missing these deadlines bars recovery entirely.
Damage Caps in Florida
Florida does not cap damages in most personal injury cases, which is favorable to victims. However, medical malpractice cases are subject to a $500,000 cap on non-economic damages against individual practitioners and a $750,000 cap against non-practitioners. These caps do not apply to economic damages.
